Objet<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">These General Conditions of Sale (GTC) govern all sales of champagnes made by <\/span><b>THE HAMADRYADES<\/b><span style=\"font-weight: 400;\">, SARL with a capital of \u20ac5,000, whose registered office is located at 10 Rue des Bois, 51390 Janvry, registered with the RCS of Reims under No. 914 827 084 (hereinafter \u00ab the Seller \u00bb), with any professional customer or consumer (hereinafter \u00ab the Customer \u00bb).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sales are made:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>online<\/b><span style=\"font-weight: 400;\">, via the secure platform <\/span><b>eShop.fr<\/b><span style=\"font-weight: 400;\">,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>on-site<\/b><span style=\"font-weight: 400;\">, at the estate located in Janvry.<\/span>&nbsp;<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Any order implies full and complete acceptance of these GTC.<\/span><\/p>\n<h2><b>2. Products<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Les produits commercialis\u00e9s sont des <\/span><b>champagnes<\/b><span style=\"font-weight: 400;\"> \u00e9labor\u00e9s par LES HAMADRYADES.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> Les descriptions et visuels pr\u00e9sents sur le site sont fournis \u00e0 titre informatif. Des variations naturelles peuvent survenir en fonction des mill\u00e9simes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Le Client reconna\u00eet que :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">le vin est un produit vivant susceptible d\u2019\u00e9volutions naturelles,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">certains d\u00e9fauts (dont le go\u00fbt de bouchon) ne peuvent \u00eatre d\u00e9tect\u00e9s qu\u2019\u00e0 l\u2019ouverture de la bouteille.<\/span>&nbsp;<\/li>\n<\/ul>\n<h2><b>3. Conditions d\u2019\u00e2ge \u2013 Loi Evin<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">La vente d\u2019alcool est strictement <\/span><b>interdite aux mineurs<\/b><span style=\"font-weight: 400;\"> (moins de 18 ans).<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> En passant commande, le Client certifie \u00eatre majeur conform\u00e9ment \u00e0 la l\u00e9gislation fran\u00e7aise.<\/span><\/p>\n<h2><b>4. Prix<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Les prix affich\u00e9s sont indiqu\u00e9s en euros, toutes taxes comprises.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> Le Vendeur se r\u00e9serve le droit de modifier ses tarifs \u00e0 tout moment, sans pr\u00e9avis, mais les produits seront factur\u00e9s sur la base des tarifs en vigueur au moment de la validation de la commande.<\/span><\/p>\n<h2><b>5. Commandes et validation<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Les commandes en ligne sont pass\u00e9es <\/span><b>exclusivement via eShop.fr<\/b><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> La validation finale vaut acceptation des CGV et constitue la formation du contrat de vente.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Le Vendeur se r\u00e9serve la possibilit\u00e9 de refuser une commande en cas de :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">rupture de stock,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">demande anormale ou frauduleuse,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">probl\u00e8me de paiement.<\/span>&nbsp;<\/li>\n<\/ul>\n<h2><b>6. Paiement<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Les paiements en ligne s\u2019effectuent exclusivement par <\/span><b>carte bancaire<\/b><span style=\"font-weight: 400;\">, via la plateforme s\u00e9curis\u00e9e eShop.fr.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pour les ventes sur place, d\u2019autres moyens de paiement peuvent \u00eatre propos\u00e9s (CB, virement, etc.).<\/span><\/p>\n<h2><b>7. Livraison<\/b><\/h2>\n<h3><b>Zone de livraison<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Les livraisons sont assur\u00e9es <\/span><b>en France m\u00e9tropolitaine<\/b><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> Pour toute demande hors France, le Client doit contacter le Vendeur.<\/span><\/p>\n<h3><b>Transporteur<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Le choix du transporteur peut varier. Le Vendeur peut recourir \u00e0 :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Colissimo,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Chronopost,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">ou tout transporteur sp\u00e9cialis\u00e9 vin.<\/span>&nbsp;<\/li>\n<\/ul>\n<h3><b>Risques li\u00e9s au transport<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Le Vendeur s\u2019engage \u00e0 exp\u00e9dier les produits dans un emballage sp\u00e9cialement adapt\u00e9 au transport de bouteilles.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> La marchandise voyage toutefois <\/span><b>aux risques et p\u00e9rils du Client<\/b><span style=\"font-weight: 400;\">, d\u00e8s la remise au transporteur, sauf disposition imp\u00e9rative contraire.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En cas d\u2019avarie, le Client doit :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">\u00e9mettre des r\u00e9serves pr\u00e9cises aupr\u00e8s du transporteur,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">notifier le Vendeur sous <\/span><b>48 heures<\/b><span style=\"font-weight: 400;\">.<\/span>&nbsp;<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Aucun remplacement ou remboursement ne sera accept\u00e9 si ces formalit\u00e9s ne sont pas respect\u00e9es.<\/span><\/p>\n<h2><b>8. Droit de r\u00e9tractation (14 jours)<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Conform\u00e9ment au Code de la consommation, le Client dispose d\u2019un d\u00e9lai de <\/span><b>14 jours<\/b><span style=\"font-weight: 400;\"> pour exercer son droit de r\u00e9tractation, <\/span><b>uniquement si les bouteilles sont intactes, non ouvertes, non endommag\u00e9es et conserv\u00e9es dans leur emballage d\u2019origine<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Les frais de retour sont <\/span><b>\u00e0 la charge du Client<\/b><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> Les bouteilles retourn\u00e9es ouvertes, descell\u00e9es ou endommag\u00e9es ne seront <\/span><b>pas rembours\u00e9es<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><b>9. Politique de retour sp\u00e9cifique (casse, erreur, go\u00fbt de bouchon)<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Les Hamadryades appliquent une politique de retour claire et conforme aux usages du secteur.<\/span><\/p>\n<h3><b>9.1. Bouteille cass\u00e9e \/ endommag\u00e9e<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Le Client doit :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">signaler le dommage <\/span><b>dans les 48 heures<\/b><span style=\"font-weight: 400;\">,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">fournir une <\/span><b>photo claire<\/b><span style=\"font-weight: 400;\"> de l\u2019emballage et du produit,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">conserver les \u00e9l\u00e9ments jusqu\u2019\u00e0 la r\u00e9solution du dossier.<\/span>&nbsp;<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Sans ces \u00e9l\u00e9ments, aucun remplacement ne sera possible.<\/span><\/p>\n<h3><b>9.2. Erreur dans la commande (mauvaise r\u00e9f\u00e9rence)<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Le produit doit \u00eatre :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">non ouvert,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">scell\u00e9,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">en parfait \u00e9tat,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">retourn\u00e9 dans son emballage s\u00e9curis\u00e9 d\u2019origine.<\/span>&nbsp;<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Apr\u00e8s r\u00e9ception, un \u00e9change ou remboursement sera effectu\u00e9.<\/span><\/p>\n<h3><b>9.3. Go\u00fbt de bouchon \/ D\u00e9faut du vin<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Conform\u00e9ment \u00e0 l\u2019article <\/span><b>1643 du Code civil<\/b><span style=\"font-weight: 400;\">, le Vendeur garantit les d\u00e9fauts m\u00eame s\u2019il les ignorait.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sous conditions :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">le d\u00e9faut doit \u00eatre signal\u00e9 <\/span><b>imm\u00e9diatement apr\u00e8s ouverture<\/b><span style=\"font-weight: 400;\">,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">la bouteille doit \u00eatre conserv\u00e9e <\/span><b>avec au moins \u00be du contenu<\/b><span style=\"font-weight: 400;\">,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">le bouchon d\u2019origine doit \u00eatre fourni,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">aucun remboursement ne sera envisag\u00e9 au-del\u00e0 de <\/span><b>24 mois<\/b><span style=\"font-weight: 400;\"> apr\u00e8s l\u2019achat, sauf preuve de conservation parfaite.<\/span>&nbsp;<\/li>\n<\/ul>\n<h3><b>Conservation exig\u00e9e :<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Le Client doit conserver le vin dans des conditions optimales :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">obscurit\u00e9,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">temp\u00e9rature stable,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">humidit\u00e9 contr\u00f4l\u00e9e.<\/span>&nbsp;<\/li>\n<\/ul>\n<h3><b>9.4. Emballage du retour<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Tout produit retourn\u00e9 doit \u00eatre emball\u00e9 dans :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">l\u2019emballage d\u2019exp\u00e9dition d\u2019origine,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> OU<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un emballage \u00e9quivalent, adapt\u00e9 au transport des bouteilles.<\/span>&nbsp;<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Tout retour endommag\u00e9 faute d\u2019un emballage correct sera <\/span><b>refus\u00e9<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><b>10. Disponibilit\u00e9 des produits<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">En cas de rupture de stock ou d\u2019impossibilit\u00e9 de fournir un mill\u00e9sime, le Vendeur pourra proposer :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un remboursement,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un produit \u00e9quivalent,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">un mill\u00e9sime ult\u00e9rieur.<\/span>&nbsp;<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Le Client reste libre d\u2019accepter ou refuser.<\/span><\/p>\n<h2><b>11. Responsabilit\u00e9<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Le Vendeur ne peut \u00eatre tenu responsable :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">d\u2019une mauvaise conservation des bouteilles par le Client,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">d\u2019un vieillissement naturel du vin,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">d\u2019un retard imputable au transporteur,<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">d\u2019un cas de force majeure.<\/span>&nbsp;<\/li>\n<\/ul>\n<h2><b>12. Donn\u00e9es personnelles<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Les donn\u00e9es personnelles collect\u00e9es lors des commandes en ligne sont trait\u00e9es par eShop.fr et par LES HAMADRYADES conform\u00e9ment \u00e0 la Politique de Confidentialit\u00e9 du site.<\/span><\/p>\n<h2><b>13. Applicable law \u2013 Disputes<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Les pr\u00e9sentes CGV sont soumises au droit fran\u00e7ais.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> En cas de litige, les parties rechercheront une solution amiable.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> \u00c0 d\u00e9faut, les tribunaux comp\u00e9tents seront ceux du ressort de <\/span><b>Reims<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><b>14.
